Terms of Service

Welcome to GetFileSense. These Terms of Service ("Terms") govern your access to and use of the GetFileSense desktop application and website (the "Service"), provided by GetFileSense ("we," "us," or "our"). By downloading, installing, or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

2. Account Registration

To access Pro features, you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at contact@getfilesense.com if you suspect unauthorized access to your account.

3. Subscription Plans and Billing

GetFileSense offers the following paid plans for the AI Organizer Pro feature:

Monthly Plan: $7.99/month, billed monthly.
Annual Plan: $69.99/year, billed once per year.

Payments are processed by Stripe and are subject to Stripe's terms. Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You can manage and cancel your subscription at any time from the application's account settings or by contacting us.

4. Free Tier

The Duplicate Finder feature is provided free of charge with no time limit. We reserve the right to modify, limit, or discontinue the free tier at any time with reasonable notice.

5. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
Attempt to reverse engineer, decompile, or disassemble any portion of the Service
Use the Service to infringe upon any third party's intellectual property rights
Share or resell access to your subscription account
Interfere with or disrupt the integrity or performance of the Service or related infrastructure
Use automated tools to scrape, crawl, or otherwise access the Service beyond your normal authorized use

6. Intellectual Property

The Service, including its software, branding, design, and content, is owned by GetFileSense and protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in the Service. Your files and data remain entirely your own property.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GETFILESENSE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO GETFILESENSE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to defend, indemnify, and hold harmless GetFileSense and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the Service or violation of these Terms.

10. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may terminate your account at any time by canceling your subscription and ceasing use of the Service.

11. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the "Last Updated" date. Your continued use of the Service after the effective date constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which GetFileSense operates, without regard to its conflict of law provisions.
